Just the Facts: Conducting Misconduct Investigations in the Workplace
Discover the proper techniques and tested procedures to investigate misconduct in a workplace. Together, Todd and Lisa will sleuth out the best questions for you to ask during a workplace investigation and how to record the answers in your interview notes. You will also discover the proper method to write an investigatory report which both supports any discipline issued, and assists in shielding the employer from liability. HR and Labor Relations professionals will be able to practice their “CSI” skills in a series of hands-on activities resembling real investigations where the names of any real persons have been changed to protect the innocent.
Who is the NLRB and What Do They Want with Our Employees?
The National Labor Relations Act (“NLRA”) applies to all employees, even those who are not represented by a Union. In this session, you will learn whether the NLRA applies to your workplace and what the current rules employers are allowed to maintain in their Standards of Conduct and Handbooks. This includes a review of important rules like employee/non-employee access to employer property, soliciting employees to join a union, video-recording operations, employee media contact, and workplace rules against bullying. Several hands-on activities will be available for participants to test their knowledge and develop the proper response to improper employee conduct.
Todd Lyon is a partner in the firm's Portland and Seattle offices. He has been a labor lawyer for over 20 years, representing public and private sector employers in labor negotiations, collective bargaining, grievance and interest arbitrations, strikes/lockouts, relocation and closures, and other litigation involving employment law and benefits. He has successfully litigated before the National Labor Relations Board (NLRB) and state labor boards in both representation and unfair labor practice hearings. Todd has developed and implemented union awareness, strike operations and impasse contingency plans. He regularly assists clients in responding to union organizing campaigns and developing labor strategies to avoid campaigns altogether. Todd formerly represented labor organizations in both Chicago and Seattle. Drawing from this union-side experience Todd provides a unique perspective to the advantage of his employer clients.
Lisa Vickery is an associate in the firm’s Portland office. Lisa’s practice focuses on representing public and private sector employers in labor negotiations, labor arbitrations, and administrative hearings. Lisa has successfully litigated unfair labor practice charges before the National Labor Relations Board and State labor boards. She also advises and provides training to employers on the interpretation of collective bargaining agreements and other labor matters.
